GM of the Year Contest Official Rules
SPONSORS: Reality Sports Online, Inc. (“RSO”), Fantasy Sports Enterprises, LCC d/b/a Dynasty League Football (“DLF”), the Rookie Scouting Portfolio (“RSP”) and Sportsguys, LLC d/b/a Football Guys (“FBG”) (each a “Sponsor” and collectively, the “Sponsors” or “Contest Entities”)
A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. ALL REALITY SPORTS ONLINE FANTASY FOOTBALL LEAGUES ARE SUBJECT TO THIS COMPLETE SET OF OFFICIAL RULES AS WELL AS THE 2014 REALITY SPORTS ONLINE TERMS OF USE THAT CAN BE FOUND AT ANY TIME AT: HTTP://REALITYSPORTSONLINE.COM/TERMS.ASPX. VOID WHERE INDICATED AND WHERE PROHIBITED OR RESTRICTED BY LAW. ALL ENTRANTS AGREE TO ABIDE BY THE TERMS OF THESE OFFICIAL RULES AND THE LEGAL DISCLAIMERS BELOW, AND BY THE DECISIONS OF RSO, WHICH ARE FINAL AND BINDING ON ALL MATTERS PERTAINING TO THIS CONTEST.
1. Overview
The Reality Sports Online GM of the Year Contest (the “Contest”) is a NFL season long contest whereby all active participants on the RSO fantasy football platform (the “RSO Fantasy Football Platform”) for the duration of the 2014 NFL season are eligible, unless otherwise restricted by these Official Rules, to compete for and potentially win prizes based on the participant’s fantasy football skill, which on the RSO Fantasy Football Platform, includes, without limitation, the participant’s ability to (a) win his respective fantasy football league, (b) evaluate and draft quality rookies in RSO’s Rookie Draft, (c) evaluate and sign talented NFL players to quality contracts during RSO’s Free Agency Auction, (d) make smart in-season player acquisitions, trades and cuts, and (e) effectively manage his salary cap for the 2014 season and beyond. More details on how the Contest award winners are determined can be found below.
2. Eligibility
Contest is open to people that are (a) Registered Users of RSO, (b) legal residents of one (1) of the United States (excluding residents of Puerto Rico and all US territories and possessions as well as residents of the states of Arizona, Iowa, Louisiana, Montana, Washington and the District of Columbia (the “Excluded US Areas”), or Canada (excluding residents of Quebec), and (c) are at least 18 years of age or the age of majority, whichever is older in their state of residence, as of the date of registration on RSO’s Fantasy Football Platform. Please note that residents of Quebec and the Excluded US Areas may register for and participate in a league(s) on the RSO Fantasy Football Platform, but residents of these areas are not eligible to win any prizes from this Contest. For purposes of these Official Rules, a “Registered User” means a person who has successfully completed the registration form on the RSO website and has obtained a user identification (“User ID”) and associated password (“Password”) to the RSO website. If you are not a Registered User, you may become a Registered User and obtain an ID and a Password by completing the RSO registration form on the homepage of the RSO website by clicking the “Register Now” button and entering the necessary information. There is no fee or charge for you to become a Registered User.
Employees, officers, directors, shareholders, agents, and/or representatives of the Contest Entities, and any of their respective agencies, owners, subsidiaries and affiliates, or the immediate family (spouse, mother, father, sister, brother, daughter, son, grandson or granddaughter, regardless of where they live) or members of their same households (whether related or not) of each such individuals are not eligible to win any prizes from this Contest (these individuals may, however, participate in fantasy football leagues on the RSO Fantasy Football Platform but WILL NOT be eligible to receive any prizes). By entering this Contest, you agree to these Official Rules and the decisions of RSO (the judging organization), which are final and binding in all respects.
3. Contest Period
The Contest Period for each entrant will last from the date that entrant participates in his league’s Rookie Draft on the RSO Fantasy Football Platform and will end on December 29, 2014 at 12:00:00 p.m. Eastern Standard Time (the “Contest Period”). After all of the first-place eligible finishers in each Active Fantasy League (defined below) are determined (the “RSO League Winners”), RSO will select from the list of RSO League Winners one (1) Grand-Prize Winner as the GM of the Year and two (2) GM of the Year Honorable Mention Winners after the end of the Contest Period. For purposes of the Contest, an “Active Fantasy Football League” is a league on the RSO Fantasy Football Platform in which the participants actively participate in the league from the Rookie Draft until the end of the fantasy season, which may or may not coincide with the end of the NFL regular season, and that materially complies with all the Sportsmanship conditions listed in Section 5 of these Official Rules.
4. Entry
To enter the Contest, an entrant must (a) visit the RSO website at “http://www.realitysportsonline.com“, (b) click “Register Now” and fill in the requested information (including your name, address, email address, telephone number with area code) to become a Registered User, and (c) join and compete in an private or public Active Fantasy Football League on the RSO Fantasy Football Platform during the 2014 NFL season. By doing the above, and subject to the conditions below, you will by automatically entered into the Contest. If you are already a Registered User and are a part of an existing RSO fantasy league, then all you must do to be eligible to win prizes through the Contest is compete in an Active Fantasy Football League during the 2014 NFL season. If you want to participate in a fantasy league on the RSO Fantasy Football Platform but not participate in the Contest, please email us after you join a team at inquries@realitysportsonline.com stating your desire to not participate in the Contest. Please include GM of the Year in the subject line of your email. All entrants agree to be bound by these Official Rules.
The RSO Fantasy Football Platform accepts registrations 24 hours a day, 7 days a week. However, to be eligible for this Contest, the entrant must become a Registered User, join a fantasy football league and participate in such league’s Rookie Draft and Free Agent Auction no later than Thursday, September 4, 2014 at 12:00:00 PM EST. Costs to join a fantasy league on the RSO Fantasy Football Platform are $9.99 USD per user per team unless the user has a promotional code (the “Hosting Fee”). The actual Hosting Fee any Registered User pays to enter his respective league HAS NO AFFECT on his chances of winning prizes from this Contest. The Hosting Fee is a service fee paid to RSO for the services and advanced fantasy platform RSO offers its customers and is not a wager or being used to directly facilitate any online gambling.
The RSO Fantasy Football Platform offers an exciting but extremely fast-paced Rookie Draft and Free Agency Auction experience that will take users anywhere from 2-6+ hours to complete depending on the size of their fantasy league. The RSO Fantasy Football Platform does allow the Commissioner of each league to Pause the Rookie Draft and/or Free Agency Auction if necessary and/or Rewind selections made in error. However, entrants need to be prepared to spend the aforementioned time to successfully participate. IF A REGISTERED USER HAS MULTIPLE TEAMS PARTICIPATING ON THE RSO FANTASY FOOTBALL PLATFORM, THE ADDITIONAL TEAMS MAY NOT BE USED IN THE SAME FANTASY LEAGUE. IF A REGISTERED USER WANTS ALL OF HIS TEAMS TO BE ELIGIBLE TO WIN THE CONTEST, EACH TEAM MUST BE IN A DIFFERENT ACTIVE FANTASY FOOTBALL LEAGUE. In the event of a dispute as to the identity of any Registered User, the authorized account holder of the e-mail address used to register will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address. The potential winner(s) may be required to show proof of being the authorized account holder.
5. Sportsmanship
By participating on the RSO Fantasy Football Platform and in this Contest, you agree to abide by the general sportsmanship rules set forth in this Section 5 of these Official Rules. You further agree to accept and abide by the rulings and the decisions of RSO regarding all questions of sportsmanship. If an owner does not comply with the sportsmanship rules as defined in this Section 5 of these Official Rules, or RSO determines (in its sole discretion) that an owner has acted in an unsportsmanlike manner, RSO reserves the right to disqualify the owner from the Contest, remove that owner from his fantasy league and/or deem that owner’s fantasy league to NOT BE an Active Fantasy Football League for purposes of this Contest. All decisions by RSO in sportsmanship and related matters will be final.
(A) Multiple Teams: In order to keep the fantasy leagues as competitive as possible, owners will only be allowed to have one team in each league.
(B) Collusion: RSO does not permit two or more owners in the same fantasy league to work together to better one team at the expense of the other (for example, making one-sided trades, one team dropping players so the other team can pick them up, etc.) Any participants or co-managers who collude, or attempt to collude, in an effort to alter the standings, rankings, or fantasy point totals will be disqualified from this Contest. Additionally, any participant that attempts to sabotage the results of the league by not giving equal effort against all competitors will be disqualified from this Contest. At the sole discretion of RSO, in any of these above circumstances, the colluding or sabotaging owner’s team may be taken over by RSO or a representative of RSO, or it may be frozen by RSO for the remainder of the season. This rule also applies to any participant or co-manager that attempts to blackmail, bribe, coerce or otherwise influence any officers or agents of RSO in an effort to alter the standings, rankings, or fantasy point totals. Any participant that does this will be disqualified from the Contest and will further have his or her team taken over by RSO or a representative of RSO. Any criminal behavior by a participant or co-manager that attempts to corrupt or alter the fairness of the Contest may result in civil and/or criminal prosecution. Any attempt made to purposely damage or affect the RSO website or RSO Fantasy Football Platform, or to undermine the operation of this Contest is a violation of civil and criminal law. RSO reserves the right to seek damages and full criminal prosecution as permitted by law.
(C) Active Participation: Participants are expected to field a starting lineup on a weekly basis and to manage their team to the best of their ability for the duration of their respective fantasy league’s season. We understand that some owners will stop actively managing their teams and may abandon them during the regular season. While the multi-year nature and overall setup of the RSO Fantasy Football Platform should encourage weekly participation from users whether they are ahead or behind in the league standings, some teams will be abandoned and RSO cannot manage abandoned teams and is not able to start and bench players for those teams. Abandoning your team and decreasing the competitiveness of your fantasy league may result in you being disqualified from the Contest and it will weaken the chances of your fellow league members of winning the GM of the Year Grand Prize.
(D) Inappropriate League Communication: The RSO Fantasy Football Platform enables owners to communicate with other league owners. We ask that you refrain from posting or sending messages that could be construed as offensive to other owners. Inappropriate communication can also include spamming other league team owners with trade offers and posting multiple messages on the message board. If a team owner is unable to abide by the guidelines specified in the RSO Terms of Use, RSO reserves the right to terminate that team owner’s ability to communicate within his fantasy league, and, depending on the severity of the offense, may disqualify the offending individual from the Contest.
6. Winners/Prizes/Odds
Winning a fantasy league on the RSO Fantasy Football Platform requires a great amount of skill. The RSO League Winners (and thus the Grand Prize Winner and Honorable Mention Winners) will be determined by how individuals use their skill and knowledge of relevant NFL players and teams as well as fantasy sports rules to accumulate the most fantasy points from week to week and have the best record (or total points) at the end of year when compared to the rest of the participants in a given fantasy league. Fantasy points are accumulated through the performance of individual athletes across multiple NFL games each week and throughout the NFL season.
In accordance with these Official Rules, the RSO League Winners will be the first-place eligible finisher in each Active Fantasy Football League on the RSO Fantasy Football Platform. From this group of RSO League Winners, two (2) GM of the Year Honorable Mention Winners will each be awarded the following prizes: (a) $100 cash, (b) free entry into a league on the RSO Fantasy Football Platform for 2015, (c) one (a) premium subscription to Football Guys for 2015, (d) one (1) premium subscription to Dynasty League Football for an entire year, and (e) the 2015 Rookie Scouting Portfolio produced by Matt Waldman (approximate retail value: $180 per prize package, $360 total for both Honorable Mention Winners). Additionally, a Grand Prize Winner will be named GM of the Year and receive the following prizes: (a) $1000 cash, (b) free entry into leagues on the RSO Fantasy Football Platform for life and a free 2015 RSO league, (c) one (1) premium subscription to Football Guys for three (3) years, (d) one (1) premium subscription of Dynasty League Football for an entire year, and (e) the 2013, 2014 and 2015 Rookie Scouting Portfolio produced by Matt Waldman (approximate retail value of Grand Prize: $1,350). The Honorable Mention Winners and the Grand Prize Winner (collectively, the “Winners”) will be determined at the conclusion of the Contest Period and when all Active Fantasy Leagues have completed their respective seasons on the RSO Fantasy Football Platform. The Winners will be determined by RSO in its sole discretion based on each participant’s ability to (a) win his respective fantasy football league, (b) evaluate and draft quality rookies in RSO’s Rookie Draft, (c) evaluate and sign talented NFL players to quality contracts during RSO’s Free Agency Auction, (d) make smart in-season player acquisitions, trades and cuts, and (e) effectively manage his salary cap for the 2014 season and beyond (collectively, the “Contest Criteria). The Grand Prize Winner does not have to be the individual who has the best record or tallied the most fantasy points on the RSO Fantasy Football Platform as scoring settings vary from league to league. RSO will analyze, evaluate and take into account all of these variables when determining the GM of the Year. The GM of the Year is determined by RSO in its sole discretion and all decisions are final and binding in all respects.
There is a limit of one prize per person per Contest. Odds of becoming a RSO League Winner depend on the number of teams in an entrant’s fantasy league (leagues can range from 8 to 32 teams) and on the entrant’s skill in assembling and managing his fantasy team. Odds of winning the Grand Prize or one of the Honorable Mention Prizes and being named GM of the Year or Honorable Mention GM of the Year depend on the total number of eligible entrants in Active Fantasy Football Leagues on the RSO Fantasy Football Platform and ultimately on each entrant’s ability to meet the Contest Criteria described above.
The Winners will be notified by email or telephone (using the email and/or phone number submitted upon registration to the RSO Fantasy Football Platform) by approximately February 15, 2015. If after two (2) attempts to contact a potential Winner no response has been received, the potential Winner’s prize will be forfeited. These potential Winners will also be required to complete and submit either an electronic or a standard Affidavit of Eligibility and Release (that may require a potential Prize Winner to provide their social security number and a copy of their driver’s license or government issued identification to confirm such participant residences within an eligible state and have the possibility of becoming an official Prize Winner) within thirty (30) days from the date RSO sends the potential Winner notification e-mail. Failure to complete and submit such documents within the specified time period may result in the forfeiture of the applicable prize. In the event of prize forfeiture, the prize forfeited may be awarded to another fantasy participant that RSO deems worthy of the GM of the Year or Honorable GM of the Year prizes, whichever the case may be.
No assignment, transfer or substitution of prize is permitted except by RSO in the event a prize is unavailable, in which case RSO reserves the right to substitute a prize for one of equal or greater value. Taxes on or connected with any prizes and the reporting consequences thereof are the sole and exclusive responsibility of the winner(s).
7. General Conditions
Except where prohibited by law, a prize winner’s acceptance of a prize constitutes permission for the Sponsors to use a prize winner’s name, photograph, likeness, statements, biographical information, voice and address (city and state) worldwide, in all forms of media and for any purpose including advertising, in RSO’s sole discretion, in perpetuity, without further compensation. Participants agree to RSO’s use of their names and likeness for advertising and publicity purposes, without additional compensation, unless prohibited by law.
All federal, state, local, and provincial laws and regulations apply. RSO is not responsible for misdirected or incomplete online registrations, entries or transactions, for incorrect, inaccurate or incomplete entry information whether caused by an entrant, equipment, or for technical malfunction or for any human error, technical error or malfunctions. RSO reserves the right to halt or modify the Contest at any time during the Contest period if events beyond their control compromise the Contest’s fairness or integrity. In the event that a scheduled football game is canceled or preempted for any reason, no points will be awarded for that week for players on the affected NFL teams.
RSO is not responsible for typographical or other human or technical errors in the offer or administration of this Contest, including but not limited to errors in advertising, the Official Rules, the selection and announcement of the Grand Prize and Honorable Mention Winner(s) or the distribution of a prize(s).
RSO, in its sole discretion, may disqualify any entrant from participating in the Contest, refuse to award points or prize(s), and require the return of a prize(s), if entrant engages in any conduct RSO deems to be improper, unfair or otherwise adverse to the operation of the Contest or detrimental to other entrants. Such improper conduct includes, but is not limited to, falsifying personal information required during Contest registration or prize claim(s), violating any term or condition stated in these Official Rules, accumulating points or prizes through methods such as automated computer scripts or other programming techniques, allowing others to use the entrant’s personal information for the purpose of accumulating points or prize(s), tampering with RSO’s administration of this Contest, or intentionally trying to defraud, reverse engineer, disassemble, decompile or otherwise tamper with the computer programs on the RSO Fantasy Football Platform and website. Entrant further acknowledges that the forfeiture of any prize(s) and/or return of the prize(s) shall in no way prevent RSO from pursuing other avenues of recourse such as criminal or civil proceedings in connection with such conduct.
RSO reserves the right to modify these rules for clarification purposes without materially affecting the terms and conditions of the Contest. This Contest is not affiliated with or endorsed by NFL or any NFL team. This is a skill Contest designed to increase consumer awareness of and interest in the RSO Fantasy Football Platform. This Contest may not be used for any form of gambling.
(A) Internet: If for any reason the Internet is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of RSO which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, RSO reserves the right, at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Contest. In such event, RSO further reserves the right to award prize(s) to the eligible players with the most points as of the termination date and to award the prize(s) to the players with the best record (tie breaker rules will apply) in each league in the Contest as of termination date or as RSO otherwise sees fit in its sole discretion.
RSO assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries or transactions. RSO is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail entry or transaction to be received on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to participant’s or any other person’s computer related to or resulting from participation or downloading any materials in this Contest.
(B) Lost or Corrupted Entries: The Contest Entities, and their parents, affiliated and subsidiary companies and advertising and promotion agencies, assume no liability and are not responsible for, and you hereby forever waive any rights to any claim in connection with, lost, late, incomplete, corrupted, stolen, or misdirected entries; or for any computer, telephone, cable, network, satellite, electronic or Internet hardware or software malfunctions, unauthorized human intervention, or the incorrect or inaccurate capture of entry or other information, or the failure to capture any such information. The Contest Entities, and their parents, affiliated and subsidiary companies, advertising and promotion agencies, are not responsible for any incorrect or inaccurate information, whether caused by registration information submitted by end users or tampering, hacking, or by any of the equipment or programming associated with or utilized in this Contest, and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to the Contest.
(C) Damaged Property: The Contest Entities, and their parents, affiliated and subsidiary companies and advertising and promotion agencies, assume no liability and are not responsible for, and you hereby forever waive any rights to any claim in connection with, injury or damage to any entrants or to any other person’s computer or property related to or resulting from participating in this Contest or downloading materials from this Contest.
CAUTION: ANY ATTEMPT BY A CONTESTANT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, RSO RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH CONTESTANT TO THE FULLEST EXTENT PERMITTED BY LAW.
(D) Dispute: In the event of a dispute as to the identity of any Registered User, the authorized account holder of the e-mail address used to register will be deemed to be the entrant. The “authorized account holder” is the natural person assigned an e-mail address by an Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with the submitted address. Any entry that is incomplete, late, or does not include a validly issued User ID will be disqualified.
In the event that the Contest is challenged by any legal or regulatory authority, RSO reserves the right to discontinue or modify the Contest, or to disqualify participants residing in the affected geographic areas. In such event, RSO shall have no liability to any participants who are disqualified due to such an action.
(E) Prize Winner(s) and Prize(s) : The Contest Entities, and their parents, affiliated and subsidiary companies and advertising and promotion agencies, assume no liability and are not responsible for, and you hereby forever waive any rights to any claim in connection with, the selection and announcement of a prize winner, the distribution of a prize, the acceptance/possession and/or use/misuse of any part of a prize and/or any injury or damage to any entrant’s or third person’s property related to or resulting from any part of a prize or any part of this Contest.
(F) Release and Indemnity: Each entrant in the Contest, including, without limitation, the Honorable Mention and Grand Prize Winners, hereby releases and agrees to hold harmless the Contest Entities and their parents, affiliates, subsidiaries, advertising and promotion agencies and their respective directors, officers, employees, representatives and agents from any and all liability for any injuries, loss or damage of any kind to person, including death, and property, arising in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of a prize, participation in this Contest and participation in any activity related to this Contest.
8. Limitations of Liability
The Contest Entities, and their parents, affiliated and subsidiary companies and advertising and promotion agencies, assume no liability and are not responsible for, and you hereby forever waive any rights to any claim in connection with, errors and/or ambiguity: (a) in the Contest; (b) in any related advertising or promotions of this Contest; and/or (c) in these Official Rules including but not limited to errors in advertising, the Official Rules, the selection and announcement of a Prize Winner or the distribution of a prize. In the event of any ambiguity(s) or error(s) in these Official Rules, RSO reserves the right to modify these Official Rules for clarification purposes or to correct any such ambiguity or error(s) without materially affecting the terms and conditions of the Contest.
IN NO EVENT WILL THE CONTEST ENTITIES AND/OR THEIR PARENTS, AFFILIATES, SUBSIDIARIES AND RELATED COMPANIES, THEIR ADVERTISING OR PROMOTION AGENCIES OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS, BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE RSO FANTASY FOOTBALL PLATFORM AND/OR THE CONTEST, DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM THE RSO FANTASY FOOTBALL PLATFORM AND/OR THE CONTEST. IN NO EVENT SHALL RSO’S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED $9.99. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON AND RELATED TO THE CONTEST PAGE OF THE RSO WEBSITE AND THE RSO FANTASY FOOTBALL PLATFORM, INCLUDING THE PRIZES ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.
9. Disputes
As a condition of participating in this Contest, entrant agrees that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or connected with this Contest, shall be resolved individually, without resort to any form of class action, exclusively, before a court located in the Commonwealth of Pennsylvania having competent jurisdiction, which Court shall apply the laws of the Commonwealth of Pennsylvania without regard for doctrines of conflict of law. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than participant’s actual out-of-pocket expenses (i.e., costs associated with entering this Contest), and participant further waives all rights to have damages multiplied or increased.
